Rear ended someone, bleh...

Short story:

coming off highway, they are in front of me, right lane to make right onto a big avenue. Based on his record he had never been out this area but he didn't know that the sign says "Right lane turn allowed when red light is on", of course so long you are safe to do so and don't get hit by oncoming traffic.

Well, dude starts going, then stops as i don't look towards the front and see if oncoming traffic is not there and thus i can turn. Next thing i know dude stops and i hit him.

Pull up to gas station, his excuse: dude i have no DL, suspended...me, ok-ish (:censored::censored::censored::censored:ing headache).

Then, it is his company van, another passanger and a third one (girl) which has no seat in these chevy express cargo van or whatever.

Cop shows up as i called them, they didnt' bother or were scared. I am at fault and the cop says that it is up to them and their discretion to go or no at that stop, TOTALLY understandable.

Next, dude has suspended license and then he says that the other dude was driving, other dude has a mexican license and permit and was driving or so he says...HMMMMMMMMMMMM.

Three backup cops show up and they arrest mexican licensed dude and i ask if i have anything to do after this whole debacle...two asshole cops: "he'll let you know, ok."

Girl and cop had a long talk and cop tells me that it is not my concern if she was ok or not based on my inquiry.

THEY ARE ALL ok but i have this bug that tells me they are going to go for medical damage...hmm, i hope not, no seatbelt and worse no third seat for her...

What a mess.:cry:
 
If you do get a call about it just tell them that he was driving on a suspended license and make sure thats in the police report for the accident.
 
i had an illegal mexican try and pull injury on me but thank god my mom is a nurse she knew what was going on and said ok ill take you to the hospital right now. the guy refused so she basically put it. you want to press charges you are coming with me to the hospital or ill call the cops right now. needless to say we didnt hear from him again lol. damn illegals! glad you are ok. looks like everything is fixable :)

Ever notice how whiplash shows up a day later? Just because your mom demanded to take him to the hospital rather than calling the cops doesn't mean crap and may have put you in a worse situation. ESPECIALLY since the cops were not involved. Absolutly nothing was documented and would go to word vs word if it ever came back on you. You need the cops there to write a police report that will save your ass later on. Showing the impact was minor <5mph, very minor damage to both vehicles, Driver refused medical treatment.... etc...

As for the OP: What happened with them lying about who was driving the vehicle? I mean, the story needs to be set straight. Even if you are "at fault" for the accident, the other driver not having a valid driver's license should help your cause in terms of insurance I would think, but I'm not sure. :shrug:

Seconded. In Texas at least you can try to prove that an accident would not have occurred if they had obeyed the law and not been on the road. It worked for my friend when he rear ended a drunk driver is was double the limit.
 
As sweet as it sounds, i still rear ended them and my insurance hasn't been able to contact their people...hmmmmmm, may not claim as both are suspended, which my insurance knows about. :cry::crazy:
 
If they don't have insurance there is no way you will get money out of them unless you sue. And if you don't sue the only other way you can get the money to fix your car would be to put in a claim on your OWN insurance. Yikes. Sue! Haha.

They have insurance, my insurance hasn't been able to get in touch with anyone or something, bleh, so my insurance is repairing my car and i am at fault while they are both driving right now for all i know.

Sounds like you need to change companies if they're jerking you around like that. The other company can't just not answer the phone to avoid it.

Why should he change companies? He isnt being jerked around at all.. He's at fault, and getting his car fixed. Its to his and his insurance companies benefit if the other insurance company doesnt answer the phone. Then his company isnt paying for their repairs as well which could effect his rates. Its standard practice for the at fault insurance to contact the 3rd party carrier, it prevents alot of lawsuits down the road.
 
Hmmmm, shop called, after their checks, car is at value of repairs and is to see what adjuster says on it. Will receive call back next week on what they decide to do (insurance - total loss it or not...).

DON'T get your hopes up on part-out, sorry, but if and only if i get to buy it back, she'll be fixed and out on the road again. :cool:
