I posted this a few days ago:

My "angry" post

and i now decided to take action against the township for damages to my car from hitting a pothole. I'm not sure how to go about doing this? I don't want a lawyer...as i been told in some cases with evidence (which i have) you can get reimbursed.

Did you get a police report?

I think that here in Westchester County, if the pothole has been reported prior to your incident,
the county is responsible for damages caused.

If the hole isn't reported and they don't know about it,
I don't think you can put a claim on it.

Either way, if you can get a cop to stop at the scene, after it happens,
and write a report, that is all the proof you really need.

I have to agree with Pete... if the pothole was not reported before then you're not going to get anything. I blew out a tire, bent 2 rims, and scratched my front spoiler on a pothole and I got nothing from the city b/c of the reason above. This pothole was even there for months but since it wasn't reported before I got screwed.

I live in berks county and out near blue marsh (local pond/river) theres a road called State road near Ganleys Pub. Anyway i filed a claim about a month ago. They were laying new pipe going across the street. The day it rains and the construction guys couldnt fill it in, i hit it at about 30 mph these were about 3 inches deep. it was in the rain and dark i couldnt see shi*. Long story short i had three yes three broken mounts. I filed a claim and talked to about 50 people that had trouble on that road as well. They said some B.S. about the road not being damaged. they wanted to make it seem like its not their fault and the road was never screwed up. i had proof, i had pictures of my car the busted mounts and the road that was screwed up. You cant get any money from this. i spent a good 3-4 hundred dollars fixing and using alternative methoods for going to work for a month. This "pothole" really screwed things up for me and the county/construction company had no remorse. you have no idea how Pisse* i was.

Yeah, that's pretty much the law on potholes, at least in NY. If it hasn't been reported then your SOL. After it's reported the city has 10 days to repair the pothole from the day the report is filed. I found this out 2 years ago the hard way when my 9 month old mystique fell into a pothole in Brooklyn and shattered the oil pan and caused a small hairline crack the transmission casing. Cost me 700 bucks for the oil pan and I never got the transmission case fixed. Sorry man....but I think you're on your own on this one.

who do you report the potholes to?

I had pothole damaged. I got a Police report and reported to my insurance. The city gave me 1500.00 for damages. I was just going to drive away imagine if i did.

In Westchester, you report them to your local Street and/or Highway Maintenance department.

If you don't know who to call, try calling your local town hall and ask.

Some towns will have you just call the local Police Precinct and report it,
and then the Police will investigate the hole and then report it to their Street Maintenance department.

It differs from town to town.

Who to report to, I believe PennDOT
use to have a 800 number
1-800 FIX ROAD or something like that..

I just found out tonight that in NYC, you can call 311 and get
the Department of Transportation (DOT) and report potholes directly to them.
