When they hear it and experience it, they will have to do something. They just can't sit around and wait for it to fail. Even if they do agree that there is a problem, it will need to be documented while your coverage is effective so the repairs will be covered. PLEASE MAKE SURE THIS IS DONE. Have you ever SERVICED the transaxle ??? The Owners Manual says it needs service every 30,000 miles, but it really needs service every 12,000 miles. If the service has NEVER BEEN DONE, they will have grounds to deny you the warranty coverage.
thing is, we bought this car used with 45k on it, we had the trans serviced at somewhere around 63k, but don't know the previous services that were done, it is an ex-rental, if you don't know what the service history is, and had it done at 20k after you bought it, wouldn't that be satisfactory?

You didn't buy the FORD ESP Warranty ? You will need to call Universal Underwriters amd talk to them. Find out of there is a field office that you can take the car to and have them look at it and possibly test drive it.
You may have to fight with them to get them to do anything on this.
I worked in a dealership and I know first hand how these insurance companies love to weave a situation that makes them not responsible for the repair.
Good luck to you and keep us informed on how well you do! We may be able to offer you some good advice, or maybe hook you up with another Contour owner in your area that knows a reputable shop.

what's the esp warranty? whatever it is, I'm sure we could have gotten it, since we got it from a ford stealership, if this transmission goes, the contour's going to have to as well, it just doesn't seem like it'd be worth paying 2grand plus 3more years on this car at $236/mo

Your trans has already failed. Dealer can hear and pull pressure checks and verify. There is a good place in phoenix that sells rebuilt transmissions. cd4e for 800 dollars rebuilt unit. called phoenixtransmission.com I think. If you are in phoenix, they might install also I don't know....
I have updated pump gasket and pump that I am planning on selling. The pump needs the updated pump plate.
