I have a question, in a case like that where you have absolutely no fault in the accident, its the other guys insurance that will pay correct? So can the guys insurance company really "total out" your car? It seems to me that it would be your decision on what happens to you car. Especially with as low value as our cars are, they are worth more to you fixed up than totaled out and having to shell out the cost of a new car. -Nick
