Yeah, I have to agree, you got off REAL lucky on that one. Sounds like the cop wasn't in a bad mood and didn't want to be an a$$. Count your blessing and slow down.

Sorry, you would think that speeding isn't probable cause, but it is. And even if you weren't speeding,,, they could make up some other probable cause thing. But speeding and any other traffic violation does equal probable cause.

Absolutely true. Now, speeding along with not giving consent to search can be turned into probable cause by a creative cop and a malleable judge, but plai ol' speeding isn't probable cause.




I wish this was not true but I belive you on this one. I most likely was skating on thin ice the last time I got stopped (for expired registration) when I refused all 3-4 times the cop asked to search my car even when he threatened to have my car towed because I did not have current registration(and even my expired registration was [censored] between what I had in my car and what was in the DMV/cop computers).

Haven't been caught once since I owned a fiero. You learn to identify every car by its headlights when your eye-level with them
But honestly, if you see their headlights and identify them, its too late.

Tail lights, not headlights. If you're going so fast you can't ID tails within a reasonable distance you're going waaaay to fast.

And I know what you mean about being eye-level, I drove a Miata for 2 years.

Wait so if you don't concent to a search that gives the cop cause to search the car, I don't think so. I have said to the cop "You don't have a reason to do so" and they just went away. I had a cop tell me I went through a drug den and that asked me if I would mind him searching the car. I said I would, becuase I didn't stop and I broke no laws, so since it isn't illegal to drive through a bad part of town he had no reason to search my car. He just drove away. Just because you don't want your car searched doesn't mean you are guilty of anything.

I got a warning ticket for driving 58 mph in a 55 mph zone in Ohio. People told me that I shoud frame that ticket because Ohio never gives warning tickets.
