i was doin 95 in a 55, at night.

didnt see the state trooper in the other lane, he was doin 65 he told me. well i see him at the last second and nail the brakes, but still passed him. he pulled me over.

after asking for license and registration, the cop had me get out, (it was a state trooper btw). he asked me if i ahd anything illegal in the car, like drugs or weapons. i told him no, which i didnt. then he did a brief search of the car, just the center console and glove box. are cops allowed to search for no reason? after that he asked me to sit inside the police car, my friend was sitting in my car. he runs my license, and was asking me questions. then since the car is in my parents name, he asked me to call my dad. so i did. he told my dad how i passed him, and then complained about ym neons (inside the car) and the tint (that i got busted for thursday and re-applied friday). my dad told the cop to scrape the tint off. the cop didnt though. the cop cut me a big break since i was very respectful, and since my dad wasnt rude to the cop either. he wrote me up for "not putting flashers on when pulled over" ticket is like $105 with no points. the cop was very reasonable, and cut be a break.

No, they arent allowed to search your car for you just speeding, unless he has some kind of probable cause or you are under arrest. What he probably did was sneak a way of getting consent to search the car into his conversation with you. However, you have had to have all of your stuff back (liscense, insurance, registration) and have been in a position to say no to the search, and be able to leave whenver you wanted to. If the search was solely based on consent, you also have the right to stop the search at any time, and the officer must comply with said request. If he had some probable cause, though, then he wouldnt need any consent and if he did ask for consent it was to be polite and for any evidence he would have found to be more likely to stand up in court as being legitimately obtained.

On a side note, you are SO lucky that ticket was only $105 and no points, and a failure to use flashers deal.

In all likelyhood though, he probably knew he couldnt have written you up for speeding because how would he prove your speed? He just knew that you were going hella fast at one time, and not fast enough when you went by him to get a wreckless driving summons on you. In other words, you lucked out dude!

Probable cause=speeding,,, seriously, you break any law and they then have probable cause... Also, probably cause could be because a description of somebody sorta matched you,etc.... Friend of mine got stopped once for no reason they just wanted to search him so he made them get a warrant and he waited there for an hour and then they searched and of course found nothing (they didn't look hard enough).

Speeding is not a probable cause to search your car.

Absolutely true. Now, speeding along with not giving consent to search can be turned into probable cause by a creative cop and a malleable judge, but plai ol' speeding isn't probable cause.

You're pretty lucky the cop didn't write you a bunch o' tickets, probably the others you got recently weren't in the computer yet since they haven't been adjudicated. He probably never got a speed on you either other than way too fast, not able to estimate enough to have it stick in court.

Slow down when you can't identify the other cars in the area, and learn what a Crown Vic's tail lights look like for Pete's sake!
