Last Sunday night, my Grandpa was driving home from my Aunt's house and about four miles from home, he nails a cow. To be more specific, a 400 lb. cow with a 2002 Taurus going at some speed above 35 mph. I don't have any pics, but it crushed the car. The whole front end is nearly gone, and the driver's side doors do not open at all. He is not injured at all. So, he calls the State Highway Patrol, they come out and write a report. Then they tell him they know who owns the cow. The patrol calls the owners and they said it was not their problem the cow was out in the middle of the road. Some people are such a$$holes Anyways, they wouldn't even call their homeowner's insurance. He called and told us this yesterday, my Dad called me and told me the whole story.

My feelings were that he should call his insurance agent and give them a copy of the police report. Then he should tell them that he wants them to contact the cow owner's insurer, and give them a copy of the report. Then they should demand that they either fix the car or total it. He should also get a rental until he can get his car fixed or get another car.

What does everybody think?

I'd like to see them make the same contention of it "not being their fault" if their car was improperly parked and it rolled into the street causing the same problem.
The cow was their responsibility.

At least get some free steaks out of it.

I think the only way they might not be liable is if the road is posted "open range".

In many states, livestock has the right of way on roads. I don't know Ohio law, so I don't know if your dad is SOL or not - he should talk to a local attorney. If he has collision on the car, he should report it to his insurance, regardless of whether they will report it to theirs.

i dont think it is the farmers fault.
now it seems to me that a cow is a slow moving animal. i have never heard of a cow setting a land speed record. i would seriously question what your grand dad was doing before he hit the cow. if he was paying any attention at all he would have seen the very large patchy black and white road ahead. i dont see how, if he was traveling at the posted speed limits, not see the cow. your grand dad is responsible on this one. just a thought or 3.

Cows are not always slow moving.

Mike, while at first I agreed with you, I then thought that MAYBE, just maybe, the cow was on the side of the road, then darted out in front of gramps at the last second. You never know.

Cows do run! Also if he had nowhere to go or if it was right around a bend. The fact that the owner said it was not his fault right off the bat makes me think your grandpa should look into this more. If he had come out and then assest that he didn't have any liability then it MIGHT be a different story. In any case its good he's alright and I hope your grandpa get another Ford product.

i sit here all day looking out the windows at cows. they are all over the place. i can tell you that they dont "dart" or "run." what they do is more of a fast walk. hahaha. it was your grandas fault.
