im not sure who you refer to when you say "big brother" but if you're referring to the po-po or the like, that would be illegal and an invasion of privacy. same thing goes as to why they can't ticket you using EZ Pass if you are speeding between tolls. obviously they can calculate your average speed but they are not allowed to use the service for anything other than its original purpose.
