I highly doubt that this post is going to help you, but I'll write it anyway (I've been fighting the urge for about 10 minutes now).
I heard a story on 20/20 or some other crappy news program, where this dude got the book thrown at him because his car made a liar out of him. The airbag system in his car (it was a late model Vet) kept a record of the vehicle's speed just prior to the bag deploying. In this case, the dude was trying to say that he was cruising around 50mph, but his car said bull sh*t, you were doing well over a 100.
So if for some reason you needed to prove how fast you were going when you hit that stupid as*, MAYBE you can. I doubt if our cars are that technically advanced.

Bad thought about that though... Some cars (and I think it started in 98) started putting those "recorders" to record the speed. I am not sure if it is in our contours and mystiques. SO honestly I dont think it will work out, unless his car has one...

Unfortunately, as far as evidence goes, the crush damage on the two cars is going to be the most influential factor. There are probably no skid marks on the road (because of the rain)but maybe there are some gouges in the pavement (from flattened tires, or other metal parts of cars). Debris has probably been kcked around too much to matter now, either. Go back to the scene, and take as many pics as you can, especially of the above mentioned items. Think CSI! Witnesses are so VERY important. If you ever get in a crash, especially a red light case, make sure that you stop a car and get that persons name and number. It will save you so much grief in the future by helping the crash investigator determine fault. This is to be the number one priority after you determine that everyone is ok. It is sickening to see how people will lie, cheat, and sell their souls during a crash investigation.

yea it is sickening. I just got the pics of the car back and I'm going to post them soon. The guy from the other guy's insurance company says that he will deny my claim because of virginia's 1% at fault law. The above mentioned law IS in VA. He says that since I saw the guy before he turned into my lane that I should have been more aware or something along those lines. He also said that the weather was a factor and I should've been going SLOWER than I was which I was already UNDER the speed limit. Oh man I'm sooo taking this [censored] to court!!! Man I HATE these jackasses.... sorry for the cussing.... Ok I'm going to try and find a host for these pics and upload them.

Dude, sorry for your accident. Here's a couple things I learned from bitter experience. If you just have liability insurance, your insurance company won't lift a finger to help you. That is what mine told me. Also, on the accident report, it's fairly standard practice for the police to list the vehicle that they consider at fault as vehicle number 1. I'm not trying to bring you down here, just stating some facts as I know them to be true here in Kentucky. Maybe Virginia is different. Hope it goes well for you.
