It's called Sovereign Immunity, and it's been waived to a limited extent by all States and the Federal Government. If I were shot by that cop's gun, you can bet your booties I'd sue.

Well, actually I do want to contribute to the contiuation of our lawsuit society. I'm a personal injury lawyer. 
It's because he left it on his car that it's called "negligence" and not an intentional act. If I accidentially forget to stop and run you over, would it matter to you that I didn't mean to do it?
I won't go into the McDonalds lady other than to say that she deserved every penny.
