Everything described is EXACTLY how it happened. All I ended up with is a ticket for destruction of private property and a court date. No ticket for anything giving them the right to use force.

My head is healing quite well although all the ripples in my head that were bumps are turning into nice green bruises. A few of the spots were I was hit with the night stick did break skin later, just not right away when the photos were taken. I have a hard head. It takes a beating well as I have proven many times (5 concussions).

I went to the hospital to get checked up and have it documented the next day. I have since really had no problems other then headaches and a few sore spots.

On Wednesday I went down to the Denver Police Internal Affairs and filed a report with the Sergeant. He was shocked that he didn't hear anything about the incident. He told me that when any officer uses force they have to fill out a paper and file it. None were filed that night. The officer whose badge number that was on my ticket was an off duty officer. He was working security in full uniform at the bar we were drinking at. 37 other cops were in the area on duty with an unknown amount of off duty hired police. The Sergeant wanted me to pick the cop that initiated it out of a line up. They brought in 9 officers and I was able to positively identify the first striking officer as number 3. After that I was put through a hour and a half questioning period. Then the Sergeant told me one interesting thing....He said that often they use force on drunks or people they beleive are drunk and 99% of the time they are too drunk to remember. He said that he bets that the officer that started it was banking on the fact that I was wasted and that is also why he just dropped me off on the curb at detox and took off.

My lawyer is actually a retired defense attorney that only does interesting cases. I have done some computer side work for him so he is going to help me out. It is always tough to beat the system but we shall see what happens. I am not after any amount of money, I just want to make an issue out of it to help prevent this from happening again!! The Denver cops are becomming known for this and it's not right!!!

And for those that think this is BS or post crap about how I would be toasted in the hospital bed with stiches......Grow up and save that for the next intake thread!

DAMN CHAD!!

I agree with you though... the DENVER cops are known for using a lot of unecessary roughness. I can tell you that I work with a lot of off duty Aurora officers who do nothing but talk crap about the Denver cops. The Aurora guys tell me that Denver cops are dicks and don't treat most right. However, it was said that the Denver cops do tend to get a lot of crap so they are quick to go on the defensive.... rather offensive.

I hope you heal quick man.... give me a call....

David

It was my friend....I explaied what happend and that the cop that dtried to arest me, did not explain my rights, nore did he give me any...needless to say he believe me over the cop (working for 2 months) and thenhe explained to his supirors that i was with him the night in question.

Well the cop got fired, and i got a settlement for the city for 3x my medical amount....(after that i had about 40,000 left form paying my bills....20,000 was my medical bills becasue i needed reabilitation.)

But now i have one thing to say:

How did you manage to disarm a police officer without getting shot ? Good f'ing job, is all I can say. Cops don't need to beat people that they already have pinned down and restrained, nor do they need to abuse their authority. There are ways of solving situations without overwhelming force. Peace at the end of a gun is no peace at all. An eye for an eye, is all I can say.

What really sucks, as mentioned in the original thread post, is that one of the female friends you (the original poster) were with ran her mouth off and got you beatup. Women are supposed to be "more mature," but many seem to act without any degree of common sense at all.

My mossberg pump and glock 19. Only time I'm calling the cops for a home intrusion is to clean up the mess and take my statement. With being trained in how to use firearms and carrying a CCW permit I'd rather take my chances defending myself than waiting for the cops to show up. The only other time I'm calling the cops is for a property crime that I need a report for in order to file a claim.

I've been witness to many instances over the years (street fights, club fights, house party fights, domestic violence) where more often than not there's at least one a-hole officer that f*cks it up for everyone else. The situation would've been completely controllable but either they aren't trained well or they're just being a-holes. I've encountered some very good cops that know how to control the situation without abuse of power, they understand the concept of give and get. But it's usually the newer cops that think their god's gift to crime fighting. There's not enough good cops out there. It just pisses me off when you got guys who were bullied in grade school and high school, and now that they got badges they think they're tuff.

This isn't meant to bash cops cause I depend on them to protect my loved ones who cannot protect themselves. And I respect their proffession for that matter the same way I respect EMTs and the Fire Dept.

A cop said to me one time 'you couldn't do my job'. I said why would I want your job when I get paid twice as much to do my job.

BS

First of all, the second you try to take a cops gun is the last second that you will spend on this earth. And, on the off chance that you do get his gun, most cops carry backup weapons. So, you might get a few more seconds before two rounds of metal are pumped into your chest. Besides, taking a cops gun, no matter if you are trying to empty his magazines or shoot him, is a felony in most if not all states. You would have been charged with that, at least.

Second of all, Miranda only applies to custodial interrogations. Therefore, if they were "beating you down", they don't have to read you your rights unless they are asking you questions while they are "beating you down".

Makes for a nice story, though.

LMAO . . . Glad to see that you have been able to keep a bit of humor with this whole messed up situation.

BTW . . . I heard that the Denver Police Department was interested in purchasing about 10,000 DTEC shields. Some guys on the force were pissed about this decision because they knew they could "make their own for like five bucks." Anyway, one pissed-off cop said that if he ever found the guy who made the DTEC shield, he was going to kick his butt. That's the real story.
