Dealers cannot refuse to repair a failed item on a now out of warranty vehicle if they were alerted to the condition when the vehicle was under warranty. I.e. if your transmission packs up but they get you going just long enough for your warranty to run out they can't refuse to fix it under warranty as the problem existed before the expiration of the warranty period.
