Not quite true...the criminal act of 'assault' involves making threats to an individual, as to make them fearful of their personal safety. 'Battery' is the actual act of attacking a person physically. Sounds to me like a case of simple assult. Go git em to settle out of court by trading in your car for a new SVT Cobra Ragtop hehe
