Yes,

Now even mild mannered me would get a lawyer. You have been more than fair and patient with them, and they have failed to perform.

So Lawyer Up!

Jato,

You couldn't convince me the IT world was slowing down. I've been my busiest ever laugh

Tell them to estaimate the value of your car! You know what its worth. If they say well its worth $$$$ and that a good quote, then tell them your ready to trade up and expect a great deal on new car. But htis probably not work and get a lawyer and stick it to them. When you see some moisture comming from their pants, you know you have them. cool

If you REALLY want to know exactly what happened with your car, check with the local Worker's Compensation court/board. If the mechanic was really hurt as badly as you say, he almost certainly would have filed a Worker's Compensation petition. (If he hasn't he should speak to a comp attorney pronto). In the comp petition, he should have stated (under oath)how he sustained his injuries.

These records should be public records and should be available to you. If no comp case was filed, your local dealership (I mean "Ford Store") is probably full of sh!t.

I also agree with JaTo about using slash and burn tactics. Something tells me that an anonymous call to OSHA might force the dealership to come clean about what happened.

It usually pays to be nice, but this has gone way past that point. It is time to let your lawyer take care of them... I would call one of the TV stations in the area that has investigative reporting and send them after the crooks. It is just plain poor business practice to treat customers as they have.. SAD!! I hope you keep up posted on the out come.

Good luck and FIGHT, FIGHT, FIGHT!!!!

[QUOTE] went into gear and ran into a tool box and the rack in front of it. The amount of damage is quite high and looks to me to have hit another car!!!?

Sounds like a crock of **** to me! I would get the authorities in on this, call the police, and maybe speak with an attorney.
I smell a lawsuit.

You have every right to be mad, but when you go to the dealer don't make an ass of yourself.

I know how fond service departments are of "hot-rodding" a customer's car. I just tore my dealership's manager a new orifice over this very issue.

If the Fjord dealer in this *case* (emphasis added - it is lawsuit time!) caused the damage, they are obligated to repair what they F'd up. Even your more conservative lawyer said that. So, in the process of repairing their first screwup, they made the car worse, not better. It is *their* responsibility to repair that damage, too.

Since we are lucky enough to live in TX, you should take advantage the gung-ho administrative agencies in state government. You've got a choice of:
Consumer Complaints (Office of the Attorney
General) 1-800-337-3928 http://www.oag.state.tx.us/consumer/complain.htm

Labor Law Information (Texas Employment
Commission) 1-800-832-9243
Occupational Safety & Health Administration 800-321-6742
Department of Licensing & Regulation
800-803-9202
Department of Public Safety 512-424-2000
Workers' Compensation Commission
800-372-7713

Good luck. Also, have your insurance company get involved with their insurance company. They have legal departments to deal with this sort of liability stuff.

*not legal advice - not a lawyer - still have my soul*
