Elizabeth, as is my understanding of Iowa employment law, if you quit a job and file for unemployement, your employer can contest it and it goes before arbitration. In Iowa, the law states that they DO NOT have to have a specific reason to fire you, which helps because they cannot contest your filing for unemployment if you get fired. I could be wrong but this is from overhearing bits and pieces of a conversation at the Iowa Workforce Development office, where people file for unemployment.

My advice, jaydog, go by your nearest IWD office and ask them what your options are.

Thanks for the help everyone.
It will be getting fired, NOT laid off. Wal mart would never have any form of lay off. This is one thing they brag about ALL the time. :Job Security" blah blah blah... Well, I havn't felt secure for about 4 months.
Anyway, we have a rate system. YOu need to unload so many pallets a night. 160 to be exact. This is in a 10 hour shift. That might sound easy, but it's not! It doesn't really matter how hard you work. It comes down to what kind of trailers (loads) you get. There are people that talk most of the night and NEVER worry about rate. Then there is little ole me, the guy that opened his mouth about going back to school.... I WOrk my ass off and still don't make rate. This is why I think they are trying to FORCE me to quit. Trying to push my buttons.... I've heard from other people that have been there a long time that they like to do that when times get a little ruff. Anyway, if you can't make rate for the week, you get "coached". 5 coaches is a step one, 3 more your on a step two, then 2 more your on a step three and they can can your azz. Well, I have 8!!!!! So I'm on a STEP TWO. This is why I say I have two weeks. Basiclly If I get screwed for two more weeks.. IM OUT THE DOOR.
As far as being fired and that looking bad to my next job..... Supposily wal mart doesn't report. I know FOR A FACT they don't give out Job references and won't say anything to people that call.
Well, guess I better get ready to go to work now. Today I'm going to talk to either the General Manager or the Personal Manager. They're the big wigs. See if they will help me out in anyway.

i learned this fact working for rockwell for 8 yrs....got in at 19yrs old and thought i had made an excellent career decision...by the time i was 25 i knew that wasn't the case and by 28 i felt that i had outgrown being treated like a kid

and then i hit that glass ceiling and extrude honed right out the door

no job security in a big corp like i thought there would be...seems to be where its 'at' is working for yourself or working for a small or very small business...u're treated like an adult, have indepence on the job, etc....

by the way i just applied for a weekend messenger job with the local newspaper for more mod money laugh ....i'd be delivering mail interoffice and running errands back and forth with customers (in my baby) or in they're hot raggedy company vehicle...probably a pickup since they requested knowledge of manual shift driving ability)

Your problem:

You are managed against a metric (x # of pallets to unload in y amount of time) that is invalid due to the way the trucks are packed, and the shipments are scheduled.

The store's problems:

(a) The shipping party is not working with the recieving party to ensure that the right resources are available to perform the tasks of unloading all the pallets when the trucks come in. The proof of this is you being overloaded and the other crew having a circle jerk around an empty truck.

(b) The performance metrics you are being measured against are not valid as the truck shipments vary.

The impact to you:

You look like a ****head and get fired.

Your plan to fix the problem:

Inform the company they are not operating to their potential efficency, and as a result are losing profits by spending too much money on staffing, as well as not moving the product to the floor quickly enough.

Who you need to contact to remedy the problem:

Contact HR regarding your performance evaluation against an invalid metric, and contact your store/regional operations manager regarding the other problem. You could try to work with your direct manager, but the problem is that you are going to make him look like a jackas here. Suggest to the ops. manager how they can fix the problem by adjusting augmenting your shift with more staff, which actually increases revenue by putting more product on the floor faster.

Other advice:

Document everything. You will need it if you get fired and seek unemployment or other remedies.

Be a model employee...be courteous, polite, and professional. Arrive to work early/on time, and leave late/at end of shift. Come to work clean and dressed appropriately.

Do not: mouth off, talk **** with other people about your boss, the company, etc., make enemies, take any bait that mgmt. lays out (e.g. encourage you to snap/walk off job/curse at your boss, etc.)

If that all works out you will be considered a 'visionary', 'team worker', and a 'problem-solver' instead of an underperformer... laugh

And get yourself a copy of the "help wanted" while you are at it...! Good luck.

A lot of people who are fired collect unemployment. The employer has to have a good reason for doing it. Don't get me wrong, if you get fired for poor attendance, stealing, fighting, etc...you're screwed. I say if you haven't found a job by the time you get "fired", file a claim. It's worth a shot. It's not a lot(50% of your average weekly wage in Ohio, up to a maximum of $308 with no dependents eek ...gross wage BTW, which means you must gross $616 a week), but it's better than nothing. Good luck with your job hunting. BTW, I went to a Union function a few weeks ago(I work for the State, either pay the Union, or pay a "fair share" for not being in the Union mad ) and I got a pamphlet that described how Wal-Mart comes in and slowly chokes the community. I would boycott that place if my wife would quit doing all of the grocery shopping there! :p

I'm looking for a new job as we speak. I just got shafted again at Electrolux. I'm sick of their ****. I got a message from Enterprise Rent-a-Car in Des Moines (I applied on-line there). Hopefully they want to set up an interview. A bit less money but at least I won't have to work in a ****ty factory anymore.
