I've read that guy's webpage and I understand the whole argument on "seeing in" and "Table X", but you have to remember that a judge will have the final say. Which do you think they are going to follow? Which did they in his case?
As far as enforcement, the PA law is written for any vehicle that passes though the state. Sure, out of state tags may get a little slack, and some departments won't really bother at all, but the point is that they can if they want to (and State Police will be sure to get on you).
And this is the exhaust check (I/M only) directly from the PA Code inspection procedure:
(6) Inspect exhaust system and reject if one or more of the following apply:
(i) The vehicle has no muffler or muffler has external repair.
(ii) There are loose or leaking joints.
(iii) There are holes, cracks or leaking seams in exhaust system.
(iv) There is a muffler cutout or similar device.
(v) Part of the exhaust system passes through the occupant compartment.
(vi) The elements are not securely fastened with proper clamps and hangers.
(vii) The exposed exhaust system does not have adequate heat shield or protective system.
(viii) The exhaust does not discharge to the outside edge of the vehicle body, including a truck bed, or as originally designed.
And regarding Allentown smog tests:
§ 177.21. Cessation of current vehicle emission inspection program.
(a) The basic vehicle emission inspection program conducted as of September 30, 1997, in Bucks, Chester, Delaware, Montgomery and Philadelphia
Counties, and in Allegheny, Beaver, Washington and Westmoreland Counties which exists in Pennsylvania Code serial pps. 125257?125266,
140091?140094, 125271?125288, 153617? 153620, 125291?125306, 182533 and 182554 will cease to be effective on a date designated by
the Secretary by notice in the Pennsylvania Bulletin as provided in § 177.22 (relating to commencement date). Certificates of appointment issued to
emission inspection stations in the program which exists in the Pennsylvania Code serial pages listed in this section will terminate on a date designated
by the Secretary in the Pennsylvania Bulletin. Emission inspection stations in the emission inspection program which exists in the Pennsylvania Code
serial pages listed in this section that elect not to be certified to conduct emission inspections under the enhanced emission inspection program shall
submit emission inspection related material to Department personnel upon a final audit by the Department.
(b) The basic emission inspection program conducted as of September 30, 1997, in the applicable areas of Lehigh and Northampton Counties will
continue as presently conducted and will cease on a date designated by the Secretary by notice in the Pennsylvania Bulletin or on November 15,
1999, whichever occurs first.
§ 177.22. Commencement date.
The enhanced I/M program, as described in this chapter, will commence in Bucks, Chester, Delaware, Montgomery, Philadelphia, Allegheny, Beaver,
Washington and Westmoreland counties on a date designated by the Secretary by notice in the Pennsylvania Bulletin or by November 15, 1997,
whichever occurs first. It will commence by November 15, 1999, in the remaining counties subject to the I/M program. The notice will provide affected
motorists with at least 60 days notice. The Department may exercise discretion in the implementation of the enhanced I/M program with respect to
phasing in the areas required to comply.
Read
this page for Lehigh and Northampton county specifics. Basically, the state never implemented any additional smog checks on 11/15/99 as specified in § 177.22. The EPA keeps pushing the state, but they keep resisting, only doing smog checks in Philly and Pitts for now.
