Of course, vehicle damage is a civil law issue, but I doubt civil law absolves an operator of the responsibility for their load. Also, in VA there is a law that ALL loads in the back of trucks/trailers/etc must be covered and completely secured. So this would make your damage very much his responsibility. Too bad you did not take his info down!

Call your insurance company. You made get a new muffler on them (less the comprehensive deductible).

If it is a county/state road, the county or state may be liable for repairs with the arguement that non-enforcement caused a liabilty. Commercial or municipal trucking/hauling is regulated by county and state regulations, so it's obvious that those reg's were being violated....prob not worth the lawyer's fees, but you could win it if you tried hard enough. I doubt a muffler outweighs attorney fees on this one. If you want to put time and effort into this yourself, you could get a settlement....easy to class-action any driver on the road if there were many haulers that day.....I dunno, it's just a muffler, right?

I've seen dump trucks line up next to each other at a traffic light..blocking all available lanes. Maybe they thought they'd drag race each other?

There was a show on TV about big trucks and the way they "own" the road! They do talk to each other on the CB radio about you on the road, so if they really want to tick you off, they will! I've seen the fully loaded big trucks pass me on the highway when I'm doing 120Kph! Some of them don't think twice about cutting you off either! Stephen

I hate 90% of truck drivers with a passion. There should be stricter laws, like no semis on the roads during rush hour!

I was driving on Highway 10 in Moorhead when a semi pulled out infront of me...so I laid on the horn...I dont think he heard me :p and I have a 1995 with the dual horns !! (although only one works  :rolleyes: )ARGH I hate semis...I swear they see my car and go "there he is, lets pull out infront of him"! Are Semis ever pulled over by cops?? Ive never seen it, nor could I imagine it happening...
