As the topic says, I have to go to court, for apparently speeding, I don't recall I was, but who knows... I could have and just havenâ??t noticed it... (It was in Carol Stream, IL for those who know) The story is, I was driving down the road, and then I stopped at a stop light, a Cop pulls behind me at the light, then I gently accelerate, get up to 45 (Speed limit) and then his lights come on, i signal to the right, and I pull over as he says, there were about 6 other people pulled over, it was a speed trap. Anyhow, I asked a CS Cop what they do before pulling people over like that, apparently the officer said, "They will get a plate number, year/make/model and color of the vehicle and report it over radio and have an officer pull that person over." So I am thinking I am going to get reamed in court... I had a court date in May, but I changed it to June, and the person did it to THEIR schedule... Therefore, I assume the officer and sergeant will show up. Itâ??s always the officers word over mineâ?¦ So I was told I should plea â??Guilty with court supervisionâ?? I never heard of that, but apparently, it will not go on my recordâ?¦ which would be nice, I am trying to keep a clean record. On the other hand, should I just fight innocent? Or try and pay the ticket early and take the penalty and record? Any input would help... (Note - I watch my speed most the time... And I was pretty sure I was going 45...)

get a lawyer. They are a bit pricey, but it is worth it if you consider the increase in insurance costs due to speeding tickets.

A lawyer would be nice... but I have no money... making payments on a 05 Taurus while being a part time employee at AutoZone doesn't exactly help...

I agree with get a lawyer. â??Guilty with court supervisionâ? http://www.co.lake.il.us/circlk/traffic.asp Originally posted by Court Diversion and Supervision: Traffic citations do not always require a court appearance. Some traffic violations may be paid to the Clerk of the Circuit Court without going to court. The police officer should indicate on the ticket whether a court appearance is required. When a traffic citation that does not require a court appearance is issued in Lake County, the offender has three options in which to dispose of the ticket prior to the provided court date:
Option A: plead guilty and pay the fine in person or by mail without coming to court
Option B: plead not guilty, request a trial and appear in court
Option C: plead guilty, receive supervision* and attend traffic school without going to court
*Supervision is a manner in which a judge withholds entry of a conviction on the reportable (moving) violation upon a guilty plea. This is conditioned on the fact that you are not issued any other tickets within 90 days. If you do not receive any other tickets and successfully complete traffic school, the case will terminate. A report of supervision will be sent to the Secretary of State when supervision is granted. The court supervision will remain on the record of the Clerk of the Circuit Court.
Important Information Not everyone is eligible for Option C. You are eligible to receive court supervision without coming to court:
1. If you have not had court supervision for any violation committed within the previous twelve months from the date of the ticket in this case; and 2. If you are willing to plead guilty on the traffic ticket, request court supervision, and pay the prescribed fines, costs, and fees for such violation (including $30.00 for traffic school)
If eligible, you will complete court supervision successfully without coming to court:
1. If you complete the four hour traffic school course within the specified time of your court supervision; and 2. If you do not receive any additional traffic citations during the supervision period
If supervision is completed successfully, the violation will be reported to the Secretary of State as a supervision.

Looks about the same to me.

Originally posted by Dupage County Website: Court Supervision without a Court Appearance Court supervision is a method in which the judge withholds entry of a Judgment (Conviction) on your reportable (moving) violation upon your plea of guilty. This action is conditioned on the fact that you do not receive any additional tickets within 90 days. (Your appearance is not normally required.) If you do not receive another ticket within the 90 days, your case is then dismissed. A report of supervision is sent to the Secretary of State where it will be considered "privileged information, available only (i) to the affected driver and (ii) for use by the courts, police officers, prosecuting authorities, and the secretary of state." (625 ILCS 5/6-204(d)). The court supervision remains on the records of the Circuit Court Clerk.
Eligibility for Court Supervision without a Court Appearance You are eligible for court supervision if you meet the following criteria:
1. This arrest incident resulted in only one moving [reportable] violation ticket being issued by the police officer. Seat belt or vehicle equipment tickets are not considered a moving [reportable] violation. 2. You have not been convicted or placed on court supervision for any moving [reportable] violations within the 12 months prior to the issuance of this ticket. 3. You sign the Affidavit for Court Supervision and pay the prescribed fine, penalties and costs for this offense as stated in paragraph [a] or of this form. This affidavit must be sent with your payment; it cannot be sent in at a later date. 4. If you desire to change your plea, you must file a written motion with the Clerk and appear on the court date set by the Clerk. If this motion to change your plea is filed within 30 days of your guilty plea, there is no fee. If filed after 30 days there is a $20.00 fee payable in advance before the motion is placed on the court call. 5. You understand that if you violate the law for another moving [reportable] violation within 90 days from the date that court supervision was granted, this court supervision may be revoked [after hearing] by the Court and a conviction entered against you and the report of conviction will be sent to the Secretary of State and entered on your driving record.
If you received multiple moving [reportable] violation tickets arising out of this incident and wish to apply for court supervision, you must appear in court at the date, time and location set by the Clerk.
If you meet the above criteria and your application for court supervision is accepted by a Judge, you will be placed on court supervision for 90 days.

If I remember properly from my speeding days, if you plead innocent at the initial court appearance (regardless if the cop shows up or not) then they'll schedule a new trial for you to argue your case. THAT is the one that you hope the cop doesn't show up for. The initial court appearance is to try and get as many guilties in as they can. There's no time then for hearing a full case. At least, that's the way it was in Wyoming. Could be different for you.
