...so while doing my taxes i realized how hard i really was taking it in the ass....heres the short version..i pay 600 a month in child support!!!! for one daughter..so 7200 a year i never see,i get taxed on it everypay period..and than at the end of the year i cant right it off or anything,so i have to pay AGAIN on money i never see....right now that 600 dollars is about fourty percent of my before tax income!!!(i dont work full time anymore b/c of school)......does anyone know of a good fathers rights lawyer or site or something..this is crazy,its not like i'm some dead beat dad...i love my daughter more than anyone person in this world,i'm not against cs,just something a little more within reason........end rant,for now

You know when I am against Child Support?

When the person who has custody makes 10x the amount of the person who has to pay the support! That and when the father has custody, but still has to pay to the mother because of "hardship."

I'm not against child support at all... I grew up on it! My mom raised my sister and I off the $500/month that my dad payed. My sister's dad was a deadbeat and didn't support her or my mom at all. My dad has supported me once I finally met him, but in a limited scope to the amount he actually makes (near 6 figure). I'm not bitter, though, just realize that I don't want to be anything like him when I have my own kids.

Is this from a divorce or a paternity situation? What state are you in? Your state may have a web site with posted presumptive child support guidelines which start out with the parents' incomes and do adjustments from there. You might have good reason for doing a formal motion to modify the support obligation. Yeah, you want to find a local domestic relations attorney.

i'm not against it either,i'd support my little girl whether or not i was forced to pay...i'm against the fact that i have to worry every month that i'll fall behind,and be sent to jail..NC is alot harsher than NY on this issue,i've been waiting my turn in court and watched several people get arrested for being in 1000 dollars in arrears...i just dont grasp how NC can get away with having me pay that much...in NY the maximum for one child is like 17-20%..not 43!!!...every year NC garnishes my taxes saying i owe them money,every month my check shows 600 dollars garnished,yet my daughters mom only recieves 530 or 560..were does the rest go?..its just a very crooked system unbalanced system

...not a divorce or paternity situation...i raised my daughter for the first three years with her mom,than she moved to NC,and left me here in NY...we had a agre'mnt for three hundred a month..worked fine for months,than one day i get a note from NC support enforcement saying i owe 2200 for back cs,and that i'm to pay 801 dollars a month!!!!!!!needless to say at 22 i fell behind pretty quick,my credit is screwed b/c of it,i owe several family member a few thousand dollars keeping out of jail over it....my daughter's mom had it lowered,but they didnt even want to allow her to lower it,i was with her when she went to apply for a reduction....they gave her such a hard time,asked me to leave so they could talk to her,thinking i was forcing her to do it...

Too bad that "agreement" you had with her while she was in NY was NOT ALSO formalized through a NY court. That's where you set yourself up for this.

If anyone else reading this on the board is in a situation similar to yours, they are also at risk for getting shafted like this by an out of state agency when a parent moves with the child and NO binding court order was already in place to set your support obligation AND prevent this crap. The lesson? Getting a court paternity/support order CAN PROTECT YOU.

I'm NOT an expert here but I'd bet Mom would still be getting $530/mo from NC even if you'd had a NY formal obligation for $300/mo before she moved, so NC would have to eat the difference, and the NY court would assert it had continuing jurisdiction for whatever fusses came up later.

And now, with her applying for assistance or whatever in NC to trigger this mess, you MIGHT be stuck having to do something with courts and/or govt. administrative agencies in NC instead of NY. That's sure not as convenient as taking care of this before she moved, is it?

You still should talk with someone who practices dom rel in your area. AND MAYBE if she is cooperative, a stipulated court paternity action order between you and her in NY or NC would pull rank on the NC agency's calculations and not cost very much. Even if that costs you $1500, you'd make that up in half a year in monthly savings.

Meanwhile, if she drops whatever form of state assistance or benefits she must be getting, then the state agency involved now probably drops out of the picture. That hearing you had must have been before an agency rather than before a REAL court, as the whole notion of "let's prevent a party from attending his own case" sounds like an agency sticking it to "Mr. Out of Towner," for a royal screwing. Did you talk with an atty while you were down there? How long ago was that hearing? Can someone argue there's been a significant change in circumstances since then to facilitate a motion to modify?

A good dom rel atty may also bring up with a court the notion of if YOU are paying BIG support $$ every month, then maybe YOU should get the TAX DEDUCTION every other year. What about when you are done with school and making real money? To whom will that deduction be worth more then?

And if that was likely a state support agency hearing, I'll bet you don't even have a formal, ENFORCEABLE visitation schedule. What if you get a new squeeze and Mom doesn't approve and thus cuts you off from visitiation? Like that NEVER happens?

Maybe a court can somewhat start from scratch on support and visitation. But file this mess under the heading of "...and you thought attorneys were expensive."

Try paying nearly 900 a month.

What pisses me off is there are no tax deductions for a parent paying child support. If I want to claim my son, I would have to get his mother's permission to do so.

Yeah, it is a [censored] up system. Those of us paying child support pay the price for all the deadbeat [censored] that dont take their responsibilities seriously.
