if you shoot me in the leg i do not need a court of law to officially tell me you shot me in the leg. it is not like joe muslum was walking down the street one day on his way to services at his local mosque of choice all the while minding his own business when some evil men threw him into the back of a black van, wisked him half around the world and randomly accused him of terrorist acts against the u.s. when he infact had nothing to do with anything. if in fact he had nothing to do with anything then he wouldn't be in guantanamo. if by some accident he happens to actually really be innocent then he will be released. accidents happen you know. and no, the vast majority of people there are not innocent or mistreated despite what some ignorant congressman might tell you, i.e. the pol pot/hilter comment.

How precisely do you suggest we treat them? Do we give them the criminal treatment, or do we give them the Geneva Convention treatment? Neither one really applies to the Gitmo detainees. Most weren't taken prisoner on US soil, but instead were captured by US military forces in Afghanistan and Iraq. But they're not members of any nation's standing army, so the Geneva Convention, which is a set of rules for militaries in wartime scenarios, has no bearing on their situation.

You HAVE to treat them as one or the other, and I frankly don't care which. It is simply wrong to hold them indefinitely on suspicion that nobody's willing to prove.

Either that, or if they are international criminals, try them in an international court.

It is simply wrong to hold them indefinitely as is.

Then the government should have no fear telling us why they are detained, whether to try them as criminals or to hold them as enemy combatants.

You seem to trust our government. I don't.

so what are we waiting for then? until they change their ways? or wither away? maybe some of them are potential terrorists but just because theyre enemy combatants doesnt mean that theyre going to strap a bomb to themselves and blow up a building. and if so, why dont we just try them and execute them already? if theyre going to hold people indefinitely, without charging them, then they might as well do it covertly and deny they even have prisoners. then the world would be off our back, although that doesnt make it right. isnt this somewhat "similar" to our pows being held for years in vietnam? even after the "war" was over? (not at all to lessen what those poor guys went through!) when a war is "over", arent pows typically returned to their country? or tried? (if having committed war crimes)
