I have a similar issue. If they are enemy combatants, then we need to hold them according to the Geneva Convention. If they are not enemy combatants, we need to follow our own rules and give them a fair and speedy trial.

If there is not enough evidence to take the matter to a trial, then there is not enough evidence to justify continued incarceration.
