When I bought my car I got rear ended a week and 2 days after I got it, July 3 2005. I did the same thing with not calling the police, dumbest move I could of ever did. But I did get all his insurance information but, when I called state farm they told me that I was going to have to use my insurance company because the driver was not covered by them but the car was. Which I seen that car is responsible for my damage I could have killed him this is the nicest car I've owned and it still great even with bumper damage. My deductible is like 1k so thats why I havn't pulled money out to get it fixed. Trying to repair as much as I can by myself. My bumper from ford out here in oak harbor wa is like $1500 loan for insurance HA HA j/k it will be fixed in a while Im debating on getting the bodykit from andysautosports.com. Well to get back to you on that it was hazardous conditions and no police report was issued so there is no proof of how it happended to your insurance company unless you told them your end of the bargain which could end up in you paying.

Yep, Who hits pays.........he hit you! If he would of seen your reverse light then he should of stopped. So he cant say you were backing up cause he would have to of seen the back up lights!

I was sitting at a light behind a truck, he decides he wants to change lanes and backs up on top of my 83 rx7. That was not my fault. It was misting and the cop thought I slide under him. Fortunately for me, he didn't lie. Unfortunately for me, his insurance card was a fake. I got a lawyer and State Farm (my insurance company) bought the right to sue him from me. My lawyer advised me to take the deal because the guy that hit me was in jail on his 2nd DUI. I guess it worked out. The car was pretty much totaled which was a shame because I loved that car.

I think I'll talk to my insurance agent or something before I call this guy to see how I should proceed.

I just checked the "fault determination rules" and in a parking lot:
19. The driver of automobile "A" is 100 per cent at fault and the driver of automobile "B" is not at fault for an incident that occurs,
(a) when automobile "A" is backing up;
(b) when automobile "A" is making a U-turn; or
(c) when the driver of, or a passenger in, automobile "A" opens the automobile door or leaves the door open. R.R.O. 1990, Reg. 668, s. 19.

Is he still able to file a police report? Is there a time limit to file one?
