Per eBay rules, he HAS to sell it to you, but all that's likely to happen in this situation is that you'll get your money back and he'll get a slap on the wrist from eBay.

Yes I have a record of the seller stating the want to keep it, I will definetly keep this handly. Thanks for the tip. Good new is this auction had Paypal's buyer protection on it, so afer 10 days if the seller refuses to send me the item I file a dispute and eventually get my money back (I imagine it will take a while). This will put a strike against the sellers account. I hope everything works out in the end. It just kills the fun of using ebay. Instead of hoping you win the auction your hoping you just get it if you do win
