Go through eBay's dispute process and do the same with PayPal. Hopefully you have the email or message from the seller saying that they are keeping it as it will greatly help your case. Per eBay rules, he HAS to sell it to you, but all that's likely to happen in this situation is that you'll get your money back and he'll get a slap on the wrist from eBay.
