The only thing I am guilty of is hitting him after he came to an immediate stop. It was like he hit a wall or something. One second we're doing 30mph the next second I see the ass end of his car in the air. He never even touched the brakes. I think he was on his cell phone wich is illegal round these parts now.

The funny thing is that I remember having a bad feeling all day and something was telling me to turn around and go home. For this reason I was being unusually carefull. There was at least 3 car legnths between us but when something like that happens in front of you all you can do is hit the brakes and pray.

If you get a lawyer, be totally honest with them, don't leave out ANY information that his party could use against you in the accident!

All I was getting at really...I was sued in an accident where the guy hit me...the judge found us both 50/50 and fault and made me pay half the guys deductible! It was retarded, I appealed and didn't have to pay anything, but the judge was so biased towards a teen. To date that is my only accident.

while you are in talks with a lawyer (do it.. period.) i'd send a letter back to the insurance company stating that you did not cause that damage. don't refuse to pay or tell them about the accident or anything, just tell them that you did not cause that damage, and see what they say.

seriously though, talk to a lawyer.

is your insurance even aware?
send that letter directly to your insurance company. That's what you pay them for.
Let them hash it out with the other insurance company.

A woman hit us once, costing us only $12 in repairs, but her bumper was fubar. Months later we got a letter saying we owed her for the damages. We called our insurance and found they were never notified by her insurance, so they took it from there.
We never had to pay a dime and our rates stayed the same.

I know your situation is different, but still, leave it in the hands of your insurance, even though you're afraid of your rates going up.
Your rates can't possibly go up $2,600 right

If you haven't already, you need to contact your insurance company and tell them to handle it. If you go with your own attorney and do not give your insurance company an opportunity to settle it, they might say that you are on your own ($$$). Ultimately, (if you lose), your insurance company has to pay (unless you refuse to give them an opportunity to "take care" of the lawsuit). I was a party to an accident 14 years ago and the other driver was clearly in the wrong but their insurance company refused to pay. But I had a police report (no fault assigned) and the other party (to my exasperation) sued me. Forwarded to the insurance company and after a few months of discussions (and a countersuit from my insurance company) with the other party (attorney to attorney), the case was dropped. My full coverage took care of my total loss but I had to take care of the deductible. I did not get a 3 year increase in premium due to the stand that my insurance company took that I was not in the wrong. Contact your insurance company and ask them what information you need to provide them immediately. Good luck.

Exactly. Your insurance company has money, that is the reason people sue. They won't get a dime from you.

You should have called the cops, plain and simple, and covered your ass. You didn't, and this is what happened. Expect to pay more in the end if you get a lawyer. I would reccommend just paying it.

FWIW, just because someone has already had an accident in front of you doesn't absolve your liability should you pile into them. It is your responsibility to maintain control of your car and refrain from hitting objects in the roadway.
