as far as the guy getting charged, who knows. there was an investigator there, and I had no guilty conscience about putting the fact that he was going 80 or so in my statement. vehicular manslaughter is probably a close bet as to what he gets, but even so, I'm sure that yesterday ruined his life. getting sued, jailtime, both, whatever. he might try to hold the person/dealership he bought the car from liable, since he only had it for two weeks and a tire blew out, but then again, they might not since he was going so fast.
as said before, it just stinks, cause the ONLY thing she did wrong was not have her seatbelt on. she was driving normally, and BAM. didn't even see it coming. I think I might give the hospital a call later on today, maybe tomorrow, see if she pulled through.

A seatbelt saved my life when my bro smashed us head on into a telephone pole 1/4 mile from my house in our '93 Grand Prix. I always wore my seatbelt before that, but it's even more prevelant, no one rides in my car without a seatbelt on, or they don't ride. I don't get people who don't wear them, and I especially don't get it just because they're in an SUV. SUV's are the most dangerous vehicles on the road! Their high narrow stance makes them especially prone to roll-over, and yet people consider them safe. Also, from what I've read, in the early 90's when SUV's went from offroad vehicle to "family car" auto manufacturers removed the roof roll-bar, making them even more dangerous! IIRC I read when doing a report on them that in 2002 there were 11,000 deaths in the US due to roll-over in accidents, and SUV's accounted for 61% of those deaths!  Anyway, I hope if I ever get in an accident, someone like you is around to help me.

Hold on. I don't think he was going "so fast". If you were merging at 65 mph and you said (I quote): "and I see a motorcycle, so I say, 'gee, let's watch out for him' ". Was the motorcycle speeding too? Generally when you're merging with traffic, you are going slower as you have to speed up to merge. Even if we assume the max speed that the Talon was going (85 mph), you doing 65 is only a 20 mph difference. Yes, faster but not significantly. Again, that's assuming the max. If he was only going 75, then this is a mere 10 faster than you were going. I don't see how he should be charged with vehicular manslaughter. Yes, he was speeding but I doubt he had any idea that his tires were on the edge of destruction. Nor do I think he happened to radio the chick in the SUV to say, "Hey babe, I'm about to wreck my car so why don't you take your seatbelt off for me?"  He was wrong for speeding and that's about it. The chick's critical condition/death is her own doing. It was her choice and her choice alone not to take the two seconds of her life to buckle a seatbelt. Moreover, I'm going to assume she's that much more irresponsible if she couldn't even make sure that the children in the rear were buckled. I send my prayers out to her and her family, but I'm not going to seek out the guy in the Talon and hope that he gets sued or thrown in jail for something he had no control over. That's just ridiculous. -SAV

last year when i was on my way to go disc golfing a lady in a pretty small car hit a family sedan which killed her and her 2 month old baby that was in her car seat in the back.
always sad to hear stuff like this

in oklahoma if you are there when the wreck happens and you dont stop and help you will get charged with leaving the scene of an accident

If his actions caused the other driver to swerve to avoid a collision he's still responsible, touch or no touch.
Let's say someone's coming the wrong way up the street at you. You swerve to avoid the jackoff and hit a telephone pole. Who's responsible?

I once saw the car in front of me hit a 10yo boy on a bike. THAT was scary. He was air lifted out of there. But I know he made it thru just fine. (BTW it was totally the kids fault)
