the full sized pic looks to be bare aluminum...it has inconsistent blotching as if it was exposed to chemical substance.....since ive posted this i have located 3 other svt's in the same general area.....so this one isnt my only option......i really appreciate the concern and im not ruling out this car...but for the price i think i can find better/less suspicious cars......
btw if someone actually replaces the svt engine with a duratech is there any recourse for the poor sap that buys the car?....

Since you have another 3 SVTs to choose, don't even bother to go that option (recourse=lawsuit=money=headaches).

Unless it was advertised or otherwise put in writing that it has the original engine, I highly doubt it.

of course there is. that is plain misrepresentation and fraud. especially if the guy is telling you it is the original engine AND an svt engine. even if he is mistaken in thinking that is (innocent misrepresentation), and it really isnt, there is still the same recourse. if i were going to buy that car, i would definitely get all of what he is saying in writing. the fact that the motor has been swapped to one that is less desireable is a material fact. it defitinely would make the car worth less (or worthless).

you can try to investigate this car and use this info to talk him down to a lower price on the car but he sounds like the type of guy that is confident with what he is talking about and that he will have no problem selling it. which is probably true, unfortunately. someone who doesnt know csvts will probably come along and not even think twice about it. i probably wouldnt have when i was shopping for a csvt.

I don't think he'd give you anything in writing...99.9% of the time you buy a car, you buy it as is. In fact on a car that old with that many miles...even the title will say as is. There isn't anything you can do if you buy it. Even if there was...your time + cost of litigation won't ever be worth the value of the car.

If you asked them if it was a specific thing (an SVT, SVT engine, SVT UIM, etc) and they said "yes" and it turned out not to be after you bought it then you could sue them for misrepresentation.

It would be an open and shut case for you because your contract decision relied on the information they told you.

Also any contract entered into under misrepresentation is voidable.

Not only that but they could be charged with felony fraud which carries high punitive damages.

you still forget in some and most states...after the car is a certain age...nothing matters. I've already gone through this ordeal with said mileage on a car that even showed on the odometer...the odometer had been changed...but even the state said it didn't matter due to the age of the car...besides there is no such thing as open and shut in a he said she said arguement.

If in doubt, don't buy it. Any after the fact dispute will cost much more than the car is worth. Remember that Justice costs! And right is not free. Too many cars out there to even consider a worrisome deal. Walk on.
