Sorry about your news, I have been in the same situation before. Mine was a `00 Focus in 12/99. In way over my head and the only way I got out of it and into the Contour was because Westland did this same thing on my credit app. I wish you luck in getting all of this sorted out. Stupid [censored] let some woman test drive my Focus on my plates while I was test driving the Contour.

Gotta be careful...especially w/ smaller dealerships...they'll screw you everyway possible.

I disagree, usually smaller dealerships are easier to deal with and more upfront. I've always avoided the "superstores" because all they want to do is move cars.

True there are those....my experience while working at a law firm and dealing with the smaller "dirty" dealerships...they are able to get away w/ it more often than not unfortunately.

this is my quick .02 on this arbitration agreement. the agreement is binding that any and all disputes arising from the sale of the vehicle must go through arbitration, instead of court (which usually favors the company). BUT, since this is a contract based on fraud it could be argued that the contract never "existed" and therefore can go before a civil court or contract court, or both. dont wait dude, be on the phone to attorneys allll day if need be until you find someone who can help you. this should be an easy fix but not one that you can handle yourself, which is what theyre banking on. this type of sh*t happens every day in car sales. its a gamble on their side but the odds are incredibly in their favor. most people will cave in and just do as theyre told.
dont even worry about this arbitration clause at this point. this would be up to the judge to decide if he/she should hear the case or if it should be heard by an arbitrator. typically, the courts dont like to see unethical business practices used to screw the little guy. the only issue i see being a problem for you is proving you didnt intend to purchase the vehicle. no matter what you say, your actions will be looked upon. this can go either way. the fraud part is only a component of this mess but is not a complete slam dunk.
btw, again, how old are you?? pllleeease tell me youre under 18.

Have you written any letters to the owner of the dealership? He may be unaware what practices his employees are following. If phone calls don't work, write a letter detailing the problem and requesting some action to resolve it. If you don't get a response, send a second letter with a copy of the first attached. Always keep a copy of your letters and always make the tone positive and friendly.
If all else fails, picket in front of the dealership, but make sure that anything you have on your sign is stating facts, not opinions, as you don't want to be sued for liable. A few hours a day standing out front may scare off enough potential customers to make them reconsider your plight.

In a way I completely agree with ODC....you aren't required to sit down and fill out the paperwork, take the keys and go home. That is your fault for not standing up and walking out of there....or for actually going inside to begin with. BUT what they did in terms of tampering with your application is wrong and should be dealt with.
If nothing else...lesson learned, huh? Never go alone so you will have someone to drag you out of there.

I do agree with the last few statements....no one co-erced you into sitting there and filling out an app....you could have left at any time- no law that states you HAVE to complete a voluntary application! That aside, I do have to say that you may indeed have a case based on the fact that they changed your income statement and you can PROVE that 1) that isn't your real income that was stated on the back (bring LOTS of evidence i.e. paystubs, bank statements, etc) ans 2) YOU never approved of the changes that were made. That being said, you left the dealership with the car, and, in their eyes YOU own it! Unless....you are UNDER 18, in which case, the whole contract is null without an "adult" co-signer.
I got screwed on the SVT, but for a different reason....I purchased it brand new and then was laid off seven months afterward and didn't get back to work for almost 5 months!! Try making a car payment when what the State SENDS you for unemployment is a car payment.....I wish you luck

not necessarily. the dealership would have to establish is that the purchase is a necessity of life. which isnt tooo difficult to do with a car. all they would have to establish is that he needed it for transportation, to get to work, to do this, to do that, blah blah blah. much more difficult to do with a $10k plasma tv. btw, this is the same in all 50 states. cases in which minors have purchased vehicles have gone both ways.
btw, even if he crashed it, and he could prove it wasnt a necessity of life, he could get his money back so always beware of the age of someone you are selling something expensive too. even if just a set of rims....
