big companies get sued like this all the time. its the cost of doing business. the only way they would be able to establish standing for a suit against her is if they can prove actual malice on her part, which they cant. ex: wendys is going to prove that the finger-in-the-chili-lady had malice when she filed her claims against wendys. even if this lady suing nissan has no real leg to stand on and the suit is ridiculous, and might even be dismissed, she does have a valid "reason" for filing the suit. its damn near impossible to establish malice in a civil suit, which is what makes the Wendys suit so sweet

she will not win against a huge company like that, i feel bad for her for loosing a child no matter even if it was her negligence (sp) cause that actualy would make it worse on a parent but she needs to let her daughter rest in peace and stop trying to blame it on others and put fault on the auto maker

Let's make all vehicles completely out of safety glass - no more of this metal stuff to get in the way. That way there won't be any blindspots for parents who let their kids play unsupervised in the streets, and the tailgaters can see exactly when the car 5 ahead of them is slamming on the brakes.

Better yet, eliminate all vehicles larger than four-passenger. Use smart cars instead.

well anyone notcie that all of the positie comments were from bible thumping hypocrites? Just makes me sad to see that people can be so blind. Im with the 90 percent of people on that geustbook that say that being negligent and backing up over your own child is not the responsibility of the auto manufacturer. I think its quite ironic that the vehicle in question has the option of a rear facing camera, though i wouldnt be surprised that this tragedy would still have occured if the cheap bastard had bought it. Obviously they were negligent in not knowing the whereabouts of a 2 YEAR OLD! and he was clearly in a hurry to not notice his own child playing outside. Shame on them for trying to profit from this and shame on those people that support them, though i hope the little girl did not suffer, its terrible to think we all cant have responsible parents.

All of this "I bought a product, misused it, and want compensation for it" crap makes me sick. Now, like McDonalds coffee cups that say "Caution, HOT, can burn, etc", every tailgate will be embossed with, "caution, if you are a jackass parent that can't keep an eye on your kid, you COULD run over them."

This is a case of somebody making a careless mistake that effected themselves, and trying to put the blame on someone else to try and ease the pain. There's an easier way to ease the pain Mrs. Clemens, and it's about $.23 at your local gun shop!

i think to be 100% honest an attorney approached her and was like look lady i know you are hurt but what if we sue the car maker and you can be rich that should help a little (and get the lawyers name out there) i dont think she should be 100% blamed for it all, i meen she may have made the biggest mistake ever but you gotta think she has to live with the fact that she killed her daughter for the rest of her life cause of her neglagince (sp) thats gotta hurt ya know, just being human here
