The teacher should err on the side of caution. Besides, someone saying their mother is in iraq and on the phone is a bit unusual and could easily be verified.

The teacher can request the student stop the call but has NO right to physically remove the phone. That kind of act should be reserved for administration only.

He could have made a better decision and contacted a teacher immediately about the phone call, and things may have gone a little differently...
The call was made during his lunch hour, therefore he wasn't in a class to begin with! The teacher shouldn't have done anything since it wasn't in class and it was a rather minor infraction. The teacher should have requested the student stop, when he refused, the teacher should have THEN contacted the administration.
