Me and my wife called the guy's house and cell phone this morning and left a messages. We just told him to call us back and that we don't want to sell the car. My wife is in tears (she NEVER cries). I'm going to try and call him again on my lunch break. I'm still out of town so I won't have this resolved till this evening.

in just about every state you have to have it in writing for any sale over $500. so you definitely can get your car back if you want to, and if this is real. i guess we'll have to wait till tomorrow to find out for sure...

i cannot believe that your wife, or anyone, would hand over the car after receiving a mere deposit.

Seriously.. let alone the person actually take the car. Shoot... my next phone cal lwould be to the cops, I'd report the car stolen.

I spoke with the "buyer" at lunch. I told him that there was a mistake and that the car is not for sale. He was understanding for the most part but the conversation went down hill after that. He eventually came to the conclusion that he doesn't have title to the car (figuratively or literally). Here's the kicker though. He said that his son liked the car and that they took it to get "looked over" by their mechanic this morning. So he wants me to reimburse him for the "inspection" fee of $120 and call it square! WTF!!! I don't think I owe him crap! Nobody told him to go and get it inspected when there was NO deal! Plus he said he got it looked at around 9:15am this morning. We called his house and cell phone starting around 8am. I think that takes precedence. I know a bunch of you are gonna say just pay the man the $120 and get your car back, but that's b.s.! This is principle here. On the other hand I don't want to fight for my car over $120. I have the extra set of keys. I could just go take it out of his driveway. Isn't there someone on here that's a lawyer? I need some advice. I'll be home in a few hours to take care of this face to face, but damn it's getting stressful!

i would go and either take YOUR car back and get your title later or call the cops and say that he is pretty much holding your car ransom till you pay him the $120.00. it is all about principal and he is screwing you over dude,,,dont take that from no one man.....knuckle up with him if you have to,hehehehe. good luck with it though, from what i hear so far thats your car and he has no legal recource but to give you the car,keys and title back or its theft....but i am no lawyer so that may not be the case

I'm just curious...did this Guy give your wife some "song and dance" knowing you were goingto be out of town because "jr" wanted to take the car for a rip?? I'll research this for you, my friend, and IM you ASAP once I get the law read...BOTH of us are not going to have a shi**y day !! (if you guys are curious as to why, check out the traffic court post I have on NECEG board)

Get the car back. Don't pay him a dime. Getting a mechanic to inspect a car is all on the potential buyers plate, not yours. Get the car back, inspect THE HELL out of it, incase they were a bit "Agressive" in their driving. Or, just play some "clutch smells burned up, WTF did you guys do" BS. If you need to, have an officer with you, incase he wants to be difficult. Take his ass to court if he DEMANDS you to pay the money. You've done nothing wrong Koko. There is no law that says you are held to a sale over "verbal" commitment. No funds have been exchanged, no contract has been signed, shoot, the actual owner wasn't even present to sign the title over, no exchange of registration has been made. For what its worth, they basically gave your wife a grand to take it for a drive... and now they are returning it when they are done to get their grand back. Find out how many miles they put onthe car. If he tried to pull this 120.00 BS, say, well, thats for the wear, tear, and gas on the car. Good day, [censored].

With a deposit down on a car your son -might- like, you do not go to your mechanic to get it checked out!!

That's HIS fault. They can argue all they want that you are not selling the car, but the simple fact is the car wasn't fully HIS to have inspected!
