Ok so about 3 months ago I had to serve 3 days in county jail for disturbing the peace (dumb drunk incident more than a year back). By serving the time I had fulfilled my obligations to the court and therefore figured I was in the clear from there on out. I havent been in any trouble in the past year, I got a good girlfriend and I stopped drinking and also got a new job which now has me working 65 hours a week between my 2 jobs. Anyways tonight im driving my CSVT back into town with my girlfriend. So I see a cop pull behind me and start following me, I was talking [censored] about them to my girlfriend saying that i know theyre gonna pull me over for the front tint on my car, I wasnt worried cause i already have a tint fix it ticket.. Anyways they end up pulling me over and tell me my expiration is expired, I actually had registration just taped to the front windshield cause its a new car. Ok so they run my info and then come back and ask me to step out of the car, they then tell me to put my hands behind my back and that im under arrest for an outstanding warrant.
I tell them that i already served time for this and that its been taken care of, they tell me it can only be resolved by a judge and that i would stay in county jail untill my court date or i made bail. They also tow my car at this time.
Anyways I ended up having to sit in jail for about 5 hours in a holding cell while i got bailed out which ended up costing $200, then i go pick up my car from impound $250, gotta say it feel AWESOME to spend 5 bills for something I know for a fact i didnt even do.
So I was wondering if anyone had any advise about my court date? I know for a fact this was a mix up and is their fault and that at court they will verify that, only problem is im out 500 bucks and my friday night. Any chance you guys think i could seek some kind of monetary compensation for their mistake?? I dunno im still kinda weirded out about the whole thing, i think im gonna get some rest and worry about it tommorow, all i can say is thank god for my dad and my girlfriend, they are lifesavers.

why didnt your gf drive your car instead of them towing it?
i think your sol on the impound fee. ive heard of people's cars being impounded before and still having to pay even though the error was cleared up.
on the bail, i dont know. someone else will chime in though.

Just playing, so how did she get home then? Did they haul her away,too? Did you have to pay an additional 200 to gether out of impound? J/K

I think there is no chance of you getting your bail/impound back. The courts are like that. Even if they make an error, they still make it seems like you are in debt to society. Be careful, though. Make sure everything the cop says is true. When he finds out you were arrested wrongfully, he could make something up like, tint+ speeding+ he was resixting (I had to ask him three times toi get out of the car+ he said stuff about my mom... etc. They will try that. No cop wants to get slapped in the face with a false arrest charge. They will make it seem like they had no choice.. warrant or not, taht you were just outright unrully. I'd go to your court date with an attorney, a good traffic attroney. Thats probably the only way of getting ytour cash back... plus maybe a little more for the mess up. But its rare. Good luck,bro.

It isn't the cops fault. If he runs your info and it comes back with an outstanding warrant, he's just doing his job. This happens sometime when the courts don't do their job by uppdating the info in the computer system!

In my area the P.D. has tow companies that work for them, when there is an error your impound fees ARE returned to you. Not sure how it works in your area.

Do some checking. Call the P.D.(Chief or Mayor) and see what they say about the impound fees. Or, ask the Judge when you go to court about getting your impound money refunded. Someone should have an answer for you.

Well if you go to court, the bail does get refunded. So that you don't have to worry about...

As far as the impound fees, you are gonna have to eat that... Just the way it is.

This scenario sounds all too familiar to me. Been there and done that one times too many...

GET A LAWYER!

Explain it to the lawyer and talk to him about recouping the fees. You can probably get them and more if you were in the right.

There is simply no other way to do it.

Lawyers charge a lot. You could easily pay more than $500 in lawyer's fees but without an attorney it is impossible to get anywhere in the legal system.
