I noticed yesterday that my digital camera is missing from my apartment. I do not know exactly when it disappeared since yesterday was the first day I wanted to use it since I moved in about a month ago. I have searched every square inch (even my car) and its nowhere.

What actions do I need to take now, besides reporting it to the front office? Should I file a police report? I really didnt want to jump to conclusions and say it was stolen, but ive looked everywhere, and the only people who have access to my apartment are me and maintenance.

Do you have renter's insurance? Sorry to say, but if not you're probably SOL. That really sucks, good luck.

I would def file a police report. While the chances are that you will never see it again, you might get lucky and if they run the serial number NCIC (national crime computer) they can see its stolen and get it back to you.

How would the complex not be responsible though if there are no signs of forced entry, and their employees are the only other people with access? Just because its my word against theirs?

Unless you have undeniable proof they stole it, like you saw it that morning and not that night. You have nothing. They should have a sign out sheet for your apt keys.

Because I'm fairly certain that somewhere in your lease it claims they will not be responsible.

How is it NOT undeniable proof when:

1. I have a witness confirming theyve seen the camera located at a specific place in my apartment.

2. Management controls the only other set of keys.

I just perused the lease. The only statement it makes towards personal items is that the "Lessor does not carry any insurance for Lessee's benefit to insure Lessee's personal property."

I'm going to assume that theft is not a "damage".

You have no proof whatsoever that they stole it, therefore you've got nothing against them. Since there's no signs of forced entry it's just as likely that you lost and/or misplaced the camera as an employee coming in and stealing it as far as a judge is concerned.
