Not to trying to be an Ahole, but which one is it? Did they steal her identity and begin to use it for credit lines or did they just her credit card number?

So far they've just used her credit card number. We're kinda waiting to see what else they'll try to do. When I talked to the numerous police departments I've called, they all said that it's considered identity theft.

If they only stole her card(s) then there is no identity theft. Identity theft involves them acutally opening accounts in her name.

Since it's just the credit card she's protected by Reg.E rules. You guys can only be held responsible for $50, provided that you notified the institutions within 48 hrs. of the theft.

Being stolen from sucks, however you look at it, but the credit card companies will eat this one. Don't fret about it.

Thanks for the clarification. I was relatively sure that we wouldn't have to eat the charges, but I'd sure like to find the MoFo's that did this a land them in jail. Of course, being a realist, I'm sure that'll never happen. I just wonder how, since they are in Florida, and we're in Kentucky, they managed to pull this off. My wife orders stuff from a place in Florida that's very near where the thiefs are. I wonder if one of the hurricanes blew stuff from the company (they did have damage) into their laps so to speak. It just pisses me off.

Most companies won't even charge you for the $50. You said she ordered stuff from a company near there. So I take it that her physical card wasn't stolen? Was her card number the only thing used? If so, then the card company will just charge it back to the merchant that processed the charges. Unfortunately, it's considered a victimless crime and the police will do nothing about it.

Before you jump to conclusions be sure that the person truely did it on purpose. I work in banking and have seen several cases where a person accidentally switched their card number and bought several things. In one case it def wasn't fraud, the women was 85 are barely could speak on the phone. In the cases where is was fraud many times there is little or no way to track it. The shipping destinations were dead ends, some use post office boxes with fake names etc. Reg E will protect you from the charges so its no loss for you. You should receive provisional credit and your credit card company will investigate.

Physical card wasn't stolen, only the number used, just baffled by how it was obtained.

Neelnug, they would have had to have done the exact same error on 2 separate days, 5 days apart. That leads me to believe it wasn't accidental. Thanks for the input though.

You'll rack your brain trying to figure it out. They could have just used an extrapolation program. Most likely the number was used by an employee at a place where your wife used the card. A database could have been hacked and the number sold to organized crime, the possibilites are endless. This is one of the most common financial crimes out there. As I said, you won't have to pay a cent and your credit card company will just charge back the sale. The criminals will get some free merchandise though. This is how these crimes work unfortunately.
