Yes, they can do that. In fact, the railroads have their own police force.

They should demand jail time. Railroad tracks are NOT intended to be a sidewalk.




A friend back in Iowa once told me a story about how his cousin and a friend fixed up an old Union Pacific railroad maintenance truck, complete with the narrow track axles and track wheels. They got drunk one weekend and decided to take the truck on what was normally a deserted track, except during planting and harvesting. Well, unfortunately for the two men, UP decided on that day they would move some equipment along that track with one locomotive and several flatbeds. The engineer saw the truck and hit the brakes. The drunks tried to throw the truck into reverse, only to have it stall. The train came to a stop and the crew surrounded the men and detained them until UP authorities could take them in. They were charged with trespassing, driving while intoxicated and were required to pay a $5000 charged by UP.
