do you have a link to the original story? there is not enough information in your post for me to make comment. although from what you said, it sounds ridiculous, but i would rather read it directly from the source. PLUS, this sounds easy enough to make a case out of. ps i dont know if it was you or the author of the article that said "was she next to the tracks or on them" but i dont think it would result in a broken finger if she was on them when the train hit her.

You cannot rationally assert that Edwards made his millions taking on crappy cases like this one. So why would you want to make a dolt of yourself by saying that?
Unless there are a whole lot of facts we don't know about in plaintiff's favor on liability, I could hardly care what her "provable" damages would be. Sounds like a BS nuisance suit by the news coverage about it.
BUT: Is that state one with "pure" comparative fault laws, where someone 99% at fault can STILL sue someone else over their 1% fault?
My state ALREADY requires plaintiffs to be no more at fault than defendants (colloquially called the "51% rule"). Maybe that state will consider such legislation.

A friend back in Iowa once told me a story about how his cousin and a friend fixed up an old Union Pacific railroad maintenance truck, complete with the narrow track axles and track wheels. They got drunk one weekend and decided to take the truck on what was normally a deserted track, except during planting and harvesting. Well, unfortunately for the two men, UP decided on that day they would move some equipment along that track with one locomotive and several flatbeds. The engineer saw the truck and hit the brakes. The drunks tried to throw the truck into reverse, only to have it stall. The train came to a stop and the crew surrounded the men and detained them until UP authorities could take them in. They were charged with trespassing, driving while intoxicated and were required to pay a $5000 charged by UP.
