do you have a link to the original story? there is not enough information in your post for me to make comment. although from what you said, it sounds ridiculous, but i would rather read it directly from the source. PLUS, this sounds easy enough to make a case out of.
ps i dont know if it was you or the author of the article that said "was she next to the tracks or on them" but i dont think it would result in a broken finger if she was on them when the train hit her.
