you dont need any legal help. thats what the insurance company is there for. you are their customer and they will fight for you in a case of he said she said. your insurance will go after his insurance to pay. if he is excluded, they wont pay. then your insurance will pay but may charge you a deductible, unless you have uninsured motorist coverage. (i have no clue what canada offers). if you have to pay for anything, then you can go after his parents, or him, in small claims to recover it. such as deductible or whatever.
That's pretty much what I just said...
