Unless your company is waaay big time cool about this, you're gonna have to sue or be in a world of hurt.
you dont need any legal help. thats what the insurance company is there for. you are their customer and they will fight for you in a case of he said she said. your insurance will go after his insurance to pay. if he is excluded, they wont pay. then your insurance will pay but may charge you a deductible, unless you have uninsured motorist coverage. (i have no clue what canada offers). if you have to pay for anything, then you can go after his parents, or him, in small claims to recover it. such as deductible or whatever.
dont worry, adjusters see sh*t like this everyday. they know how to sort sh*t out even when BOTH parties are lying. theyll believe you because youre older and have a good record (i presume) in other words, responsible. they see him as already lying by driving illegaly. credibility has a lot to do with it.
**ps word of advice to everyone** keep a disposable camera in your glove box for instances such as this. if you get in an accident, do NOT move the cars, if possible, until you take pictures of them sitting there.--this is excellent advice i was given by an adjuster. adjusters can tell by the positioning of the car how the accident happened and who is at fault, typically. usually people move the cars to the side and then discuss, then it makes it more difficult cuz the adjuster will have to go by strictly verbal accounts and just looking at the damage. (a bit of CSI involved)
