it's not a matter of should coulda woulda... it's a matter of the law. if you shoot someone, and you had other options out (especially with lots of witnesses), you're going to jail. simple as that. hell, you shoot someone even when you don't have an option, you may go to jail. it's not a pleasant experience, but it beats the alternative.




actually, we just talked about this in class the other day. battery and self defense. you may only use reasonable force to defend yourself, or another. lethal force is only justified in a life and death situation. based strictly on the footage i would say that he was just bashing the car. shooting him, for what we saw in the video, would be excessive force and the shooter could be looking at some trouble. had he pulled the lady out of the car, then it could be reasonably viewed as reasonable force. of course, that would all be up to the jury who may possibly feel he was doing the right thing. along with the prosecutor who may also feel this way and not decide to press any charges.
just my 2 cents.

and yes, he is correct, if you have an option out, it is highly advisable to take it.
