Well, this may be off the mark, but he said he couldn't see around the truck and pulled out / (backed up?) into oncoming traffic. Yes if she wasn't on the phone maybe she wouldn't have hit him, but I beleive it is the car entering the flow of traffic that is responsible to make sure it is safe to proceed (even in a parking lot).

that depends on circumstance. usually, the person pulling out is at fault. In this case, you said she was on the phone and was haulin' down the aisle. it can be argued, and won, that you were already pulling out and she didnt see you in time (yappin on the phone) and plowed into you. if she reasonably had time to stop, had she been driving at a reasonable speed (remember its 5mph in a parking lot) and paying attention, she should have been able to stop in time. small claims court cost about $25 to file and you dont need a lawyer. you dont have much to lose. As far as her flippin it and suing you, in most states now, you cant sue someone in an accident if you dont have insurance. i think it would be worth it for you to think about especially since you said youre doin the college thing and dont have lotsa cash to throw around. why pay for your repairs if you dont have to? did you get a report from the police officer?
just to clarify things for everyone, or at least for me, you were pulling out of a parking space, into an isle? and she t-boned you?

Sorry to hear about the accident... The same thing happened to my aunt last year at the gratiot cruise. She got t-boned when she was crossing the road.... all the traffic yeilded to let her through, and some retard flew up on the shoulder at around 50mph and totaled her car. Sent her to the hospital for a long time... and did I mension totaling the car, it was a an older firebird or camaro I think.

dude my mom almost had the same issue, it was a wee bit different tough in my contour,
she was pulling around an isle... and this crazy old hag smashes into the front end with her cadillac... of course it totally ruins the whole front bumper and hood etc.. was a sad site...
the cop tried to tell my mom it was her fault, uuntil she relized the old hag was cuttin across the parkin spaces over the yellow lines.. to get across the lot to a parkin spot while MY mom was driving between the lines...
my mom sued her. lol, and won pretty easily. I say sue the [censored] for being stupid!

That's okay Ross. I had my own little party at the house last night. Don't remember much...that means it must've been good.  Anyway, I just got back from a local collision center and the guy quoted me $950.00 for the damage. That's including paint, but I mean I knew it would be a lot, but not near a thousand dollars. Looks like I'll be picking up some more shifts at work. Guess that's life, but I'm up for it if it means my car will be fixed and looking good again.

Cooolness. We had a good time, there should be pics floating around, I'll show you if they ever get posted. Slept in my car last nite, I'd rather sleep in there than on a floor with some other dudes. Storm woke me up this morning though.  I forgot my ants have car, still need to get them outta there. $950 isn't too bad. I know it's a lot considering you're the one paying it, but it couldda been worse.

Agreed. Here's another classic example of someone who does something stupid and wants sympathy for it. You pulled out in front of this lady Chris, you've already owned up to it. Cell Phone + Lifted Silverado didn't = Bad day for ZX2... Your bad judgement = Bad day for ZX2. Be a man, take ownership in your own faults and move on.
And for your "friend" ... lol. If my friend did something this stupid - I wouldn't go around to other forums chasing people because they made fun of him for it. I'd be the one laughing at him as well. Kermit, lay off the sauce long enough to realize that everything you did in my thread was a total waste of time. in a parking lot, "hauling" would be anything over 5mph (per most states' vehicle codes). i dont think 5mph would have done that much damage.
