Well, this may be off the mark, but he said he couldn't see around the truck and pulled out / (backed up?) into oncoming traffic. Yes if she wasn't on the phone maybe she wouldn't have hit him, but I beleive it is the car entering the flow of traffic that is responsible to make sure it is safe to proceed (even in a parking lot).

It is. Although she was the idiot on the phone, it was my fault because I didn't yield to traffic.
that depends on circumstance. usually, the person pulling out is at fault. In this case, you said she was on the phone and was haulin' down the aisle. it can be argued, and won, that you were already pulling out and she didnt see you in time (yappin on the phone) and plowed into you. if she reasonably had time to stop, had she been driving at a reasonable speed (remember its 5mph in a parking lot) and paying attention, she should have been able to stop in time. small claims court cost about $25 to file and you dont need a lawyer. you dont have much to lose. As far as her flippin it and suing you, in most states now, you cant sue someone in an accident if you dont have insurance. i think it would be worth it for you to think about especially since you said youre doin the college thing and dont have lotsa cash to throw around. why pay for your repairs if you dont have to? did you get a report from the police officer?
just to clarify things for everyone, or at least for me, you were pulling out of a parking space, into an isle? and she t-boned you?
