Only audio. Video, anybody can.
Unless he has video, he has nothing. If he has video of your car with your plates and you driving, then you're done. However ALL of that has to be on the tape for them to give YOU a citation. If its just your car and your plates, then you can still get a fine since the car is registered to you, but you wont get any points, like you would if you were on the video doing it.
