pdx...what your saying makes sencse but,my problem was/is we were together when she left,i was supp. move down a month after she got settled,ya know,so we both werent hunting for jobs at the same time..of course she realized she didnt need me and told me not to bother coming down...so i couldnt of made a court order here,other wise i would've had a stay,so she couldnt leave the state with my daughter without my permision.....the problems not so much her anymore,i can see daryn anytime i want with or withhout notice,i stay at her house,we get along great,etc..btw she doesnt get any assistance from the gov't,her parents own a house down in nc,her and her sister live in it for free,while her parents live back here in ny

So she decided to use a recovery service to milk you. If NC isn't trying to recoup money they are dishing out to her, then this is simply her doing. She could drop this all together and you could make an agreement outside of court with the assistance of an atty.

Has custody been established in any type of court order? IIRC, you weren't ever married, so I'd bet she has full physical/legal custody.

A lawyer does wonders in situations like these.

So whats throwing someone in jail going to fix? Then how are you going to work to pay for anything, going to lose your job and dont they take your license away sometimes? I hate reading stories like this. Im only 24 and no kids but the system is all assbackwards in my eyes. If it came down to it i would be more then happy to support my kid.

My divorce has written into it that we alternate deductions every year. I claim my daughter in the "odd" tax years, like 2005. My ex-wife claims her in the "even" years.

It doesn't make sense for CS to be deductable. You get to deduct no more than the standard deduction if you don't divorce, so why would you think you get to deduct CS if you divorce or have to pay support because of a paternity action.

FWIW, I pay $1k/month in CS and probably 2x that much in taxes

Getting a tax break on that $12k/year might save me $4k

The greatest deal is that $12k/year is a bargain compared to living with my ex-wife.

I saw that she has a credit card from her affair partner, so she can sponge off him for a while. Poor Sap.

I do imagine you can get the support order changed since you are in school, trying to earn more, which will ultimately benefit your child by increasing your earning potential.

Part of my agreement is that I get to claim my son every three years. I guess my lawyer's $4000 fee was worth it. The thing that gets me is in Ohio it's based on combined income, so if she gets a job making alot more money, I gotta pay her more if she goes to court to redo the support order.
