sorry to hear the news. ive been there a few times myself.. anyway, you might want to contact your insurance and explain the situation. they can tell you for sure who is at fault. if they say she is at fault then you can take her to small claims court to recover your damages, and then some. do you have uninsured motorist? comp/collision? if youre deductible is pretty low and you have no prior claims you can claim this under comp/collision and just pay youre deductible, which is likely less than the amount to repair your car. hopefully, she can be determined to be at fault and you can go after her.

It really falls into a lose/lose situation for me. I have USAA, listed under my parents as the primary driver of the ZX2. It only has liability. No full coverage, it's too much for me to afford. I have a $500 deductible. Only the other vehicle in an accident will be fixed, but in this case the only thing being fixed on the Silverado will be a broken license plate frame and a bent tow hook. Reviewing the damage might show why that is: This is just my assumption, as she had backed up before I got out of the car and looked at how the two had collided. I may be wrong about the tires thing.

I fell for you...My wife got T-boned a couple years back in her 93 v8 t-bird. Luckily she was unhurt b/c the engine absorbed all the impact...cracked the block and totaled it. She was at 3 way stop and the other lady in a jeep cherokee never even slowed down for hers and wham. No insurance either. Took her to court but the lady's uncle was a judge and he had his buddy dimiss the case and actually fine my wife. She got out of the fine b/c her 2 uncles are cops and they pulled some strings. It's all B.S. in my opinion...

Well, this may be off the mark, but he said he couldn't see around the truck and pulled out / (backed up?) into oncoming traffic. Yes if she wasn't on the phone maybe she wouldn't have hit him, but I beleive it is the car entering the flow of traffic that is responsible to make sure it is safe to proceed (even in a parking lot).
Sucks though - at least you weren't hurt!

Just another reason why stores, malls anything with a big parking lot should be required to have a spot just for cars, a different one for SUV, trunks and vans. It is so hard to see if some fat ass SUV parks next to you, your basically backing out as if you were blind.

That doesn't stop people from driving while talking on thier cell phones though. I have no problem backing out of a spot sandwiched between two farm trucks. If the drivers cars in the lanes are paying any sort of attention they will stop and let me out. People have enough trouble with handicapped spots, do you think people with SUVs are going to drive past an empty spot near the front door of the shopping center because it's in the "not for trucks" section?

It is. Although she was the idiot on the phone, it was my fault because I didn't yield to traffic.
