Back Ground!

My father owns a shop and his accounting has been done by a family friend in exchange for car repair and favors. Well, they had a falling out and she will not pick up the phone or return his calls.

The problem is she has all his paperwork necesassary for him to complete his bussiness taxes.

What legal right do either of them have to the paper work?

He is willing to compensate her but she won't even speak to him.

In legal terms, the void of a contract has occured. You no longer repair her car, she no longer does the paper work. Becuase the paper work to this company is that of the property of the company, she is REQUIRED by law to return them. File suit in a small claims court or get an attorney. Gather proof of the inplied contract (repairs for paper work service), and a decent attorey should have no problem getting through the motion for dismissal. Has he tried going to her residence? Calling froma diffrent number?

he is definitely entitled to his paperwork. have him contact an attorney immediately. im sure a threatening letter from a lawyer will have her returning that paperwork in no time. this is not a matter for small claims court.

Thankg guys,
That's what I needed to know. He has a lawyer. I wanted to know because I'm writing a letter for him to try and get the paper work back amicably prior to a court case.

make sure you send it via certified mail w/ return receipt

and CC your attorney at the bottom of the letter
